Terms of Service

These Terms of Service (“Terms”) govern your use of the AdaptiveTest platform and any services provided by Woodstock Software LLC (“Woodstock Software,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms.
1. Service Description
AdaptiveTest is an AI-powered adaptive testing platform designed for K-12 education. The platform includes:
- An adaptive assessment engine powered by Item Response Theory (IRT)
- AI Question Generator that creates standards-aligned assessment questions using Anthropic's Claude AI
- AI Learning Recommendations that generate personalized next steps for teachers
- Integration with school systems via OneRoster (SIS), LTI 1.3 (LMS), and QTI 3.0 (question standards)
2. Accounts and Access
School administrators and teachers create and manage accounts. Student access is provisioned by authorized school personnel. You are responsible for maintaining the security of your account credentials and for all activity under your account.
3. Acceptable Use
You agree to use our services only for their intended educational purpose. You may not:
- Attempt to access data belonging to other schools or users
- Use the platform for purposes unrelated to education
- Attempt to reverse-engineer, exploit, or compromise the platform's security
- Use AI-generated content in ways that misrepresent its origin
4. Intellectual Property
Questions generated by the AI Question Generator are owned by the teacher or school that created them. Assessment data and student records belong to the school or district. Our platform code, design, and underlying technology remain the property of Woodstock Software LLC.
5. AI-Generated Content
Our AI features are powered by Anthropic's Claude AI. While we work to ensure quality and accuracy, AI-generated questions and recommendations should be reviewed by teachers before use. We do not guarantee that AI-generated content is free from errors.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
7. Payment Terms
Paid subscriptions are billed according to the pricing plan selected. Free trials and pilot programs are available as described on our website. Cancellation takes effect at the end of the current billing period.
8. Limitation of Liability
To the maximum extent permitted by law, Woodstock Software LLC shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
Either party may terminate the agreement at any time. Upon termination, we will provide data export options and, upon request, perform data deletion in accordance with our Privacy Policy.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, United States.
